These Terms and Conditions govern your use of our website and the services offered by DELYNFORCE TRAVEL AND TOURS. By accessing or using our website and services, you agree to comply with and be bound by these Terms and Conditions.

1.Passport and Visas

a. You must have a valid passport and all applicable visas, permits, and certifications, including immunization certificates, for the duration of the voyage, and you accept full responsibility for completing all necessary arrangements. If You do not do so, the Company will have no liability to You for any cost, loss, or damage that You may incur, and the Company will not refund the cost of any unused portion of Your travel arrangements. You should check with the relevant embassy for the specific criteria for Your chosen tour and travel dates. Any information or assistance provided by the Company is provided in good faith, but without any liability on the part of the Company.

2. Booking and Reservations:

a. All reservations are subject to availability.

b. A non-refundable deposit is necessary to book a reservation. The remaining money is required 60 days before the tour begins.

d. The deposit for each tour is $350.00 USD per person if paying in US Dollars, £250 GBP Sterling per person if paying in British Pounds and €300.00 EUR per person if paying in Euros. Upon receipt of Your booking form and deposit, the Company will send You a confirmation invoice, at which moment we will enter into a legally binding contract. Please double-check that all information on the confirmation invoice is correct, including the spelling of names. If it is not, please notify us in writing as soon as possible. The individual making the reservation acknowledges these contract terms on behalf of everyone in the group or party. The Company will also offer You a complete trip itinerary, including instructions on equipment and clothing for your excursion, upon confirmation

 

  1. Payment
    1. The remaining tour cost is due 40 days before your departure date. If the balance is not paid in full by the due date, the Company maintains the right to cancel Your vacation, retain Your deposit, and levy cancellation fees where applicable. Please keep in mind that no reminders will be given. If you book fewer than 40 days before your travel date, the full price is due at the time of booking.

 

  1. Cancellations and Refunds:
    1. Cancellations must be submitted in writing and are subject to our cancellation policy, which is detailed throughout the booking process.
    2. b. If applicable, refunds will be processed in accordance with our return policy.
    3. The Company maintains the right to cancel Your trip at any moment before to the scheduled departure date. In such cases, you will be offered an alternate excursion of comparable quality. If this is not acceptable to You, all money paid for the trip will be repaid in full (for example, if the trip is cancelled due to Your failure to pay in line with the payment requirements in clause 3).
    4. If the Company cancels Your trip, You will be unable to make any further claims for compensation for loss or damage howsoever arising, including consequential losses, expenses, vaccinations, visa fees or other travel arrangements.

 

  1. Change Of booking by you
    1. Changes to Your needs or travel itinerary will be approved if you notify us in writing at least 60 days before your departure date. The Company considers notification to have occurred on the date of receipt. Any additional costs incurred as a result of the adjustment will be charged to You.
    2. b. In addition, a $75.00 USD fee will be assessed to cover the administrative costs involved with the change. This administrative fee will be applied even if the requested alteration to Your itinerary is not possible. Changes requested within 60 days of departure will be treated as a cancellation of Your trip, with the cancellation charges outlined in clause 4.
    3. Transferring from one trip to another must be requested at least 60 days before the departure date. If the Company accepts the transfer request, the Company maintains the right to charge a fee of 10% of the first booking price to cover administrative costs. You are responsible for paying any remaining balance in the trip price in accordance with the payment processes outlined in clause 3 above.

d.(i) Before a booking is made, the Company maintains the right to make any changes or modifications to the facilities, services, or rates indicated in the brochure. Any such changes will be communicated to You before a booking is finalized.

ii) While the Company will make every effort to run all trips as stated, it reserves the right to make reasonable adjustments to the holiday if the Company deems it necessary or advisable. Minor modifications (such as different departure times, flight durations, or amended itineraries up to 10% of the trip duration) will be communicated to You as soon as reasonably possible before the departure date. Minor modifications are not acceptable as grounds for cancelation. In the event of Major Changes (defined as any modification affecting 10% or more of the trip's duration), the Company will notify You in writing of Your options of accepting the alternative arrangements, selecting another available trip, or receiving a full refund. Following such notification, You must tell the Company in writing of Your decision within 7 days.

iii) If the Company is forced to cancel or modify Your trip due to 'force majeure,' such as war, threat of war, riot, civil unrest, fire, adverse weather conditions, strikes, industrial action, terrorist activity, global and local pandemics, natural or man-made disasters, or other similar events beyond the company's control, no compensation will be payable or liability accepted beyond the options listed above.

 

  1. Cancellation by you
    1. If you wish to cancel Your vacation, the person who signed the booking form must contact us in writing as soon as possible. The cancellation is effective as of the date You notify us. You will forfeit your money if you cancel 60 days or more before your travel date. If you cancel fewer than 60 days before your departure date, the following cancellation fees will apply: Period prior to departure during which we get written notification Cancellation fee expressed as a percentage of total tour cost 60 days or more prior to departure - Deposit loss 59-31 days before leaving date -50% 30- 16 days prior to departure -75% -100% if booked 15 days or less before travel date The final tour fee will include any extras you purchased for Your trip. The Company strongly advises You to purchase a cancellation insurance coverage at the time of booking.

 

  1. Cancellation by the company
    1. The Company maintains the right to cancel Your trip at any moment before to the scheduled departure date. In such cases, You will be offered an alternate excursion of comparable quality. If this is unacceptable to You, all money paid for the trip will be repaid in full (unless if the trip is cancelled due to Your failure to pay for the trip in line with the payment terms in clause 3).
    2. If the Company cancels Your trip, You will have no further claim for loss or damage of any kind, including consequential losses, expenditures, vaccines, visa fees, or any travel arrangements.

 

  1. Code of Conduct:
    1. Travelers are expected to behave responsibly and respectfully towards fellow travelers, guides, and local communities.
    2. Any behavior that violates local laws or jeopardizes the safety of others may result in expulsion from the tour without refund.

 

  1. Sustainable Tourism:
    1. We are committed to sustainable tourism practices. Travelers are encouraged to minimize their environmental impact and respect local cultures.

 

  1. Health and Safety:
    1. Travelers are responsible for assessing their fitness and health suitability for the chosen tour.
    2. Any pre-existing medical conditions must be disclosed to us before the tour.

 

  1. Your booking
    1. You recognize and agree that the nature of African travel necessitates flexibility and allowances for alternatives. The trip itineraries provided should not be construed as contractual obligations of the Company. Rather, they should be viewed as an indicator of the group's goals, and as such, the route, schedules, itineraries, hotels, facilities, and method of transportation may be subject to change without notice owing to unforeseen or unforeseeable situations. Alternative accommodations shall be of the same quality as the original accommodations specified. There will be no refunds for services that are not used.

 

  1. Risk and Accountability
    1. By making a reservation, You acknowledge and accept the potential dangers and hazards of adventure travel, in addition to the usual risks connected with international travel, and You declare that You are both mentally and physically capable of undertaking Your selected trip. Injury, sickness, and disease are some of the risks of adventure travel, as are distance from medical services, loss or damage to possessions, pain and inconvenience, and extreme weather conditions. You recognize that Your decision to travel to Your desired destination is based on this information, including any Foreign Office advice, and that You are willing to accept the personal risks involved with such travel.

 

  1. Travel Insurance
    1. Travel insurance is required for all Delynforce travel and Tours trips. Personal accident, death, medical bills, and repatriation charges, including air ambulance and helicopter rescue, must be covered by your travel insurance. The Company strongly advises that Your coverage be expanded to encompass cancellation, curtailment, loss of effects, and any other expenses incurred as a result of loss, damage, injury, or other inconveniences. Furthermore, You must confirm that no exclusion clauses limit coverage for the activities included in Your trip. It is solely Your duty to ensure that proper insurance coverage is in place. If the Company is not satisfied that adequate insurance coverage is in place, it reserves the right to cancel Your booking at any time before the departure date. At least two weeks before Your departure date, the Company will request documentation verification of Your insurance coverage.

 

  1. Tour Alterations and package tour regulations 1992
    1. We reserve the right to alter itineraries, accommodations, and activities for reasons beyond our control. Alternative arrangements of equal value will be provided.
    2. The trips and packages offered by the Company comply with all relevant aspects of the Package Tour Regulations 1992 and other relevant legislation. To the extent that these terms and conditions are inconsistent with such legislation, the terms and conditions shall be read so as to comply with the legislation.

 

  1. Independent arrangement:
    1. You make independent arrangements outside of the scope of the tour totally at Your own risk. If You make extra travel plans while on vacation through the Company, its agents, or suppliers, the Company accepts no liability in carrying out such booking. In such cases, the Company operates solely as a booking agent, and all responsibility concessions outlined in the preceding sentence are void. Your only recourse will be against the organizations that provide the separate arrangements.

 

  1. Intellectual Property:
    1. All content on our website, including text, images, and logos, is the intellectual property of Delynforce Travel and Tours. Unauthorized use is prohibited.

 

  1. Privacy Policy:
    1. We value your privacy. Our Privacy Statement explains how we gather, handle, and safeguard your personal information.
    2. b.The Company takes its obligations under Ghana Data Protection legislation seriously and employs appropriate security measures to protect the information it has about You. When you book a trip with us, you authorize us to share information about You with our agents and suppliers, and the Company cannot be held liable for the conduct or omissions of our agents or suppliers in relation to such information.

 

  1. Governing Law:
    1. These Terms and Conditions are governed by the laws of Ghana. Any disputes will be resolved in Ghana Court.

 

  1. Amendments:
    1. We reserve the right to amend these Terms and Conditions at any time. The revised terms will be posted on our website.
